Laws regarding Sales Commission payment reporting?

Asking for a friend...

A large part of his wages is his commission, which of course is based on various tiers of revenue, and the addition of new business for that time period.

He has asked numerous times for a report to help verify if his commission is calculated properly. Upper management has barely responded, but never honored his request.

Are there state or federal laws regarding this?

Unfortunately for him, one that pays pretty damn good, but who knows if it's the agreed upon commission.

I work in IT sales, have been at both resellers and manufacturers and at none of them have the commission reports never been readily available. Is “your friend” upset that they aren’t getting reports or the accuracy of reporting and transparency of the commission payment structure. If it’s the latter welcome to sales and be ready to fight your company for what you earned. It’s funny after a couple of times doing that it either magically fixes itself or the fight at end of month/qtr/year gets easier.

Did he sign a contract where the commission pay structure is laid out? Very common in sales. If so, I'd reference the contract with upper management and point out they are not providing an accurate way to assess the commission owed.

I haven’t received a commission report in months but it keeps going up, so I’m not asking any questions

Do they even need him? Why not just have a website with a list of what they sell?

And what kind of slapdick sales rep can't put together an Excel spreadsheet to calculate how much he's owed?

Some sales are a little more complicated than others.

This commission is based on recurring orders that happen monthly, change in volume every month, with 40ish accounts. Bonus that occurs with new business that the rep can't always see the date when the new business begins.

The bonus is also paid out upon revenue received. The rep surely can't see when an invoice paid.

That kinda slapdick sales rep.
