All you did was shift the dilemma over. These two constitutional rights are still being treated differently.

You are correct there is not equal treatment amongst individual rights and liberties, but why shouldn’t there be. I honestly haven’t thought about the question before, but there are limited situations where you have to register and get permission to exercise a fundamental constitutional right, but all seem to involve the use of a commons (e.g a parade or protest). The latter can be highly controversial and subject to strict scrutiny. In many states a mere expression of the right EVEN ON PRIVATE PROPERTY requires state registration and in some cases state petmission

Because the rights they address are very different from one another and none are absolute. For example, the right to keep and bear arms is often thought of as a right to have guns, but that’s not what it says. If taken to be absolute we would each be able to keep and bear nuclear weapons. Now that’s insane. So we put reasonable limits on the second amendment. What is reasonable is obviously subject to intensive and passionate debate, but the debate must be had, because no one sane thinks we can allow everyone to have rocket propelled grenades, tanks and ballistic missiles.
