Of course, there'll be legal battles but as of right now, they're illegal.

The juice isn't worth the legal cost in 99% of the situations anyway. And they were toothless in most states already.
But yes, this is pretty big news.
I'm on the fence on these. If you sign it, you sign it, why is the government involved? Are they going to void clauses in professional sports contracts that state players can't be traded to division foes, etc.?

The real problem with them whether legal, illegal, unenforceable, etc... is if you sign one and the company comes after you... you are going to spend some money.
About $80K+ to fight one if it is in your state. If you signed one with a big company that has their headquarters designated in a state like Conneciticut (that is pro business) then you can expect to pay quite a bit more if you are going to fight it from TX, LA, MS, AL, etc...
Most lawyers will advise you to just just sit out the 1-year non-compete.

Is not signing it really an option if you want the job?

Why is the federal government involved in consensual employment contracts?

No. But not taking the job is certainly your option, just like every other condition of your employment.

I have never willingly consented to signing one in my career. I've always needed to sign it if I wanted the job. My balls were in a rope and I was hanging from it.

So you did consent. Just as you consented to your salary, job duties, other policies, etc.

Because non competes are against individuals and totally one sided for the business. Plus there is a difference in means and sophistication of the parties. Why do want business to frick people so badly.

What if I sell my business to someone and then go right out and start another business just like the one I just sold?

Imagine the audacity of a business to protect their investment and operations.
How selfish of them.

This seems like an over reach by the FTC.

It's not really consensual though. People signed them because they had to, to get the job. It's one thing to agree to certain bullshite while employed for someone, but an employer should not have any say once you've parted ways.

It actually very much is selfish, literally by design. Noncompetes are absurd aside from very specific provisions and circumstances.
Also, the vast majority go unenforced so let's all cool the feigned indignation.

The inevitable circuit split on this point will have this rule in front of SCOTUS shortly.
