Jonathan Lopez, 31, of Orange, California, has been charged with one felony count each of murder, hit and run with permanent injury or death, evading while driving recklessly, DUI with three or more priors and driving with a blood alcohol level of 0.08% or higher.

Lopez could also be charged with driving on a suspended license, a misdemeanor. He faces a maximum sentence of 18 years to life in prison if convicted of all charges.

He already spent 16 months in jail. It was 11:15a in the morning. He flipped off the cops before being arrested, which tells me he pretty much doesn't give a frick.

And only a possible 18 year sentence for all charges including murder? WTF happened to life with no parole?

Not just a California problem. In Louisiana a family friend is just now getting closure after a drunk driver hit and killed their son three years ago.

It was the guy's 6th DUI.

Yeah as much as I despise CA. This is a US problem. We are way too lenient on drunk drivers.

The family of the victim should be allowed to sue the DA(s) for dereliction of duties directly leading to the preventable death of the victim.

Compared to the rest of the US, Louisiana and California are on a different level of shittiness when it comes to prosecuting criminals.

Multiple DUI convictions happen in Louisiana before anything serious is done more than anyone wants to admit. Doesn’t make it right or less serious than this situation but it’s a problem here as well. I’m not casting stones at California for this.

Qualified Immunity? Imbler v. Pachtman says prosecutors have absolute immunity.
