If they are speaking as to the decision today, SCOTUS did not speak to the CO courts' factual determinations that Trump was guilty of insurrection.

But, according to Liberals, you don’t have to be convicted of an insurrection, you don’t even have to go to trial, someone just decides you are guilty. When I ask who makes that call, I get crickets. They can’t defend their position.

1. What happened to "innoncent until proven guilty in a court of law?"

2. If is not innocent of committing insurrection why hasn't he been charged with that crime?

Because the only statute that addresses it has not been used so it cannot be addressed

Court said the federal level (Congress) determines when we can use article 3. One would assume Congress would have to have a “hearing” ie follow impeachment proceedings. Congress (senate) aquitted Trump twice. Technically they can try to impeach in house for “insurrection” but would still need to follow 50%+1 in house and 2/3 in senate.

Why the downvotes?

The SCOTUS did not address it.

It concluded the State of CO had no authority to disqualify a candidate for federal office under the 14th.

It did NOT find he did, or didn't, foment or participate in an insurrection.

For the record, there was no insurrection on 1/6.
