I can just hear this old guy talking to his defense lawyer. "What do you mean they can get copies of text messages? I thought those were encrypted or something?"
I have a buddy that works in the Intelligence Community in VA. Last time I had drinks with him in DC, I asked about WhatsApp and services like that. He said, "if it's sent or received on your cell phone, a computer or a good old fashioned phone line. It can be intercepted and read. Period."
