You can file up front & wait the year or live separately for a year and then file. I believe the former protects you more because it stops community property during the waiting period, but I could be wrong. It’s been a while since I researched.

Advice was not intended to be the first step in the process. Was assuming separation had already happened and both parties were involved. It is very accurate that the away party can just decide to move back in and the clock resets.
Your point has been noted however. Is there an official way to protect oneself from this type of reset? Maybe it can only be done after initial filing and such.

You can get a type of temporary restraining order that is apparently common when filing for divorce. I didn’t, but I’ve seen a few women include it in their divorce filing. It made it so the husband had to move out immediately and couldn’t remove marital property unless a cop/witness was present. It’s pretty bullshite, but they’ll apparently issue a TRO in this case (without real basis) that lasts until you go to court. I can’t recall the specifics since it’s been years, but it was an effective way to get a spouse kicked out of the house.

I was speaking from experience btw, 6 months into separation she just moved back in and just like that, back to zero. I had emails proving lack of consent but attorney wouldn't touch it.

See an attorney. While you have to live separate and apart to get the divorce there may be things that can be done to cut off your responsibility for your spouse's debts before that time runs.

Wife got tired of me hunting too much, not spending enough time with kids etc. Now wants to separate. Been together 15 years.
