Firearms lawyer - Lafayette or surrounding area?

I've been fighting with the FBI and ATF for over a year now. They just wrongly denied my 2nd VAF. Going the Congressman route and I'm sick of fricking with them. Very strongly considering suing, or at least pay someone else to do this circus.

Does anyone know any lawyers that specialize in 2A law?

what are they denying you from? simply purchasing a firearm or what?

No, I'm not a prohibited person and can still purchase. It all started when they denied a suppressor which shocked me. ATF says they couldn't get background check from the FBI in the time allowed (WTF?) Couldn't figure out what was going on. Filed for VAF and they came back saying I need to inquire at the courthouse in the Parish I used to live in.

Digging into it, they did something which flagged an old arrest, from 18 years ago, that went nowhere. Charges were dropped. But somehow that was enough to flag me, so they denied it.

Filed for 2nd VAF with letters from DA explaining that the charges were never brought forward and they have no intent to prosecute.

FBI now says they can't verify the info. I don't think they even tried. So basically I keep getting the run around.

Obligatory, frick the ATF.

I'm not in disagreement, but maybe also if people didn't go around getting arrested the feds would have a tougher time getting their boot on the people's neck.

No reason to give them any more excuses to trample your rights than they already have.

Oh man. This sounds like a nightmare. The ATF has unlimited lawyers and bureaucrats to stone wall you for years.

Well, try having a batshit crazy ex-wife who claims you were violent to be spiteful, so they arrest you to investigate. When it turns out to be complete bullshite they drop the charges and apparently don't clean up the paperwork on their end, leaving innocent people holding the bag and getting buttfricked over their rights.

Thanks. Will see what Congressman can do, it's Higgins so while he's very pro-2A, not sure how he'll move on it. I spoke to him at a function we were both at a year ago and he didn't have much good to say about fighting with the ATF.

I've got some resources at the state level (Senators that are good friends) so might see if they want a piece of this too, although I understand they're limited on the Federal level.

Hence why I think paying a lawyer to fiddle with all this may be fruitful as well. The bureaucracy is endless for the common man.

You might have some luck with NRA and other advocacy groups. They probably have a list of lawyers that they could refer you to. I see no reason why you would be limited to a local attorney to handle an issue at the federal level. I would look for someone that has this type of experience. You're not likely to find that locally. Just my $0.02.

Meplat Group out of Metairie is owned by an attorney. Don't think he specializes in 2A law but could be of great use with his knowledge of 2A. Hope that helps.

Were you just made aware that the arrest had not been expunged, or have you been fighting it for 2 decades?

I'm late 50s and have been either military or a federal civilian employee since I graduated high school. You'd be surprised how little sway most members of congress have with federal agencies. Especially if the member of congress is a different party than the administration and not in party leadership.

This sounds like a wet dream for a lawyer, he's going to charge you $400/hour to write a letter/do research once a month. Federal employees are unionized and protected and not intimidated/motivated by lawyers in the least bit.

I'm not discouraging you from taking the above steps just trying to set your expectations. It's going to be a long, frustrating process, I'd try to keep my expenses low.

See....this right here is why we need to fight tooth and nail against every single piece of gun control legislation brought up at any level of government. If they didn't try to F with people like this on the regulation side and stayed up and up then maybe it would be different, but they don't so it's not.

I still got delayed for every purchase I ever made until last year. I purchased a shotgun and told my FFL guy "I'll be back in a few days to pick it up."

He gets off the phone and goes, "They said to proceed." (He knows me well and knows my situation)

I'm not sure what changed but I did all the stuff you are mentioning over 10 years ago and all of a sudden I'm back in good standing.

It’s almost impossible to get the arrest expunged. Once you are booked and the info goes to AFIS database it’s like herpes. It’s always there and pops up from time to time. The AfIS database is the electronic fingerprint system located in Claksburg,WV. Almost every LEO booking agency has a machine that is connected to a state database that send to the FBI database.

I actually did speak to people about getting it expunged. I was told "there's literally nothing to expunge because it went nowhere. It never even went to court."

I asked them about bringing it forward to dismiss in open court and they said they can't even do that.
