How does she not know purposivism as a judge? Hell I know what it is and I had one semester of undergrad Con Law when I wasn't even a pre-law student...

Typical totally clueless liberal judge that will end up deciding people's fates when she probably couldn't spell her own last name until she was in high school.

Kennedy often exposes these nominees as fools, or at least severely lacking in knowledge, or that they are political ideologues incapable applying the law as it’s written. They all get the votes, in the end. They all get confirmed. So will this mental lightweight. It’s Kabuki theater.

Kennedy is pretty much there to be a professional troll at this point.

Not that I mind it, as that still probably puts him as our best national level politician given that Cassidy is a worthless cocksucker and Scalise isn’t necessarily dependable.

She really doesn't have to know anything; she'll be told how to rule on the decisions by one of the partisan clerks chosen for her by a democrat party operative.

He's just going through the motions now with his trolls. I'd have more respect for him if he came back home to run for Governor to get this state fixed. He would win but probably doesn't want to work that hard to collect a check where he can just troll Biden nominees.

I found it interesting he mentioned the 5th & 2nd article of the constitution and then told her you will be faced with dealing with purposivism.

The purposive approach (sometimes referred to as purposivism,[1] purposive construction,[2] purposive interpretation,[3] or the modern principle in construction)[4] is an approach to statutory and constitutional interpretation under which common law courts interpret an enactment (a statute, part of a statute, or a clause of a constitution) within the context of the law's purpose.

Scholars associate traditional purposivism with Church of the Holy Trinity v. United States. There, the Court held that a statute prohibiting the importation of a foreigner “to perform labor or service of any kind in the United States” did not apply to a church’s importation of a British pastor. In so holding, the Court conceded that the “letter” of the statute clearly encompassed the pastor but found that its “spirit” — evidenced through “the circumstances surrounding its enactment,” “the intention of its makers,” and the “results which follow from [a broad reading]” — suggested that Congress intended it to apply only to manual laborers. Because of the “familiar rule” that a statute’s “spirit” trumps its “letter,” the Court explained, the statute could not be read to cover the pastor.

Purposivism is the ideologue of the demagogue who is of the intellectual idea that third parties, absent of firsthand personal knowledge, know what is best for everyone.

In the name of equity, they will disregard the rule of law.

She clearly stated near the end that if she was ever presented with something such as the constitution she would research it and incorporate prudent judicial philosophy regarding it into her decisions.

It's unreal, isn't it.

Kennedy is of an age and intellect coupled with a knowledge of American history, politics, and law that when he sees the resumes on some of these nominees for federal judge, he probably just shakes his head. I don’t think he “barks” enough.

A nominee for federal judge should have wisdom, experience, intelligence and knowledge of the laws and Constitution of the United States. It’s not as if she exhibited lack of knowledge of the existence of some federal regulation regarding swine herding. He asked her about The Constitution of the United States and a method of judicial interpretation of statutes that Kennedy probably learned in Con Law 1 at UVA a half century ago.
