It’s not a company policy that busts good employees as much as it is workers comp, disability, or as said accidents on the job.
Until there’s a test that proves when you were last high, the fact is if you are doing something like driving a vehicle and someone hits you then you are going to get tested and likely pop positive.

According to the federal government, any drug that’s a schedule 1 drug, has no safe or acceptable medical use, and there’s a high risk for substance abuse. Opioids are schedule II which means they are acceptable for medical use, under certain rules of course.
Basically schedule I drugs are LSD, heroin, meth, and weed. One of these things is nothing like the others. Really two of these things are nothing like the others, but LSD is chemically made so that makes it more risky than natural shrooms, but that’s a story for another day.
This is why you can’t be exempt from a drug test even if you have a prescription for it, because the law states that weed is dangerous and bad for you lol. Doesn’t really make a lot of sense, but this is what all the pro weed people really need to push for, is for that shite to be removed from the schedule I drug list. Doesn’t need to be legalized by each state or whatever, it just needs to be removed from the list it’s currently on. It shouldn’t even be a schedule II or III drug, but it’s a start I guess. Just remove it as a schedule I drug.

Painkillers, opioids, cocaine, PCP, all listed as a schedule II drug, which means it has acceptable medical use, but can still be easily abused. Schedule I drugs have no acceptable medical use, according to the law, but schedule II drugs do.

First off it is not a prescription. It is a recommendation. It all depends on the company policy ultimately.
Biggest issue in the work place is that there is no POC test for being high like there is for alcohol.
It definitely needs to be addressed by most companies.

More and more, companies are dropping MJ screening requirements except for those operating machinery/equipment.
We hire and place thousands of people a year and unless our customers specifically request it, we don't screen for MJ anymore. Also, we don't test for MJ for our own positions anymore.
But to answer your question, it just depends on the company.

That’s not the point I’m trying to make. Medical weed isn’t even on the same level of acceptance as opioids and pain killers. In order to use opioids and be exempt from being fired, when it shows up on a drug test, you have to have a current prescription for it, and you have to let your employer know about this. There are also some jobs that won’t let you work if you are prescribed opioids, but they won’t fire you for it. Comes down to company policy.
Because weed is a schedule I drug, whether you have a prescription or not, you will still get fired when it shows up on a drug test. If weed were moved to a schedule II drug, then you could use it medically and with a prescription, and not have to worry about being fired, as long as you tell your employer and show a current prescription.
The point I’m making is that even though medical marijuana has been approved in the majority of the country, you still aren’t exempt from drug testing and being fired because you smoked weed, because it’s on the list of Schedule I drugs. There’s no acceptance for weed period in many industries still because of federal law. There’s some leeway for alcohol, opioids, and other drugs because they aren’t Schedule I. Doesn’t mean you can’t be fired for using those drugs, but there is some acceptance for anything that isn’t Schedule I.
