The Sun is always moving across the sky, transcending it from our field of ground vision. A "sunset" is merely the Sun leaving the "quadrant" or that field of vision and leaving it. The horizon represents its vanishing point. IF you happened to elevate yourself by 10' at that moment, the Sun would still not yet have "set". (and yes, the sun does grow smaller.)
A sun that is shrinking (as it leaves the field of vision) is smaller because it is now much further away than when it was directly overhead. This proven in many examples of photography -- if you want to research it.)

What school did you go to? What you should have learned there is that scientific theories do not ever get "promoted" or "upgraded" to "fact" or "law". A theory can only ever be replaced by another theory.
The phrase "it's only a theory" is nonsensical in the context of science.
