Couple sues fertility clinic, saying they had to abort stranger’s baby

Specialists at the New York Fertility Institute, which they had paid for the IVF procedure, repeatedly assured the couple that the test was not a problem and that they were, in fact, the biological parents, court records state.
But the parents worried the test was accurate — that they weren’t the parents and that the clinic had transferred a stranger’s embryo into the woman’s uterus. Fearing the emotional toll of a potential custody battle once the baby was born, the couple chose to terminate the six-month pregnancy days before it would have been illegal to do so, according to court records.
In the lawsuit, the couple also alleges the clinic and all three doctors purposefully covered up that the doctor who did the procedure “has a history of mistakenly implanting a stranger’s embryo into the wrong patient.”
An abortion after 6 months.... And there could very well be a real biological mom out there who would have given anything to have her baby carried to term. Imagine being told you finally had a baby through IVF, even if it was birthed by another woman the result of a mistake, only to find out it was aborted late-term.
And who knows how many swaps this clinic did and how many kids were not born to bio parents or maybe one set of parents had multiple embryos implanted in different women...sheesh. Maybe this doc was just grabbing whatever viable embryos he had with no regard for parentage just to get successful pregnancies.

Yeah, this is one of those abortion should be illegal moments.
Aborting a 6 month old fetus is pretty damn sick, especially based off what their reasoning was.

This is a weird story, and I can see how the parents would be devastated since they were lied to.
But if you want a baby and have one … but it’s not yours … you kill it?

This part makes me skeptical overall. My wife and I had to do IVF and they do this prior to transferring the embryo to gauge viability. So not sure why the couple would do months after the fact only to discover this...

Some of these type doctors are sick folks.
I seem to remember a story a few years ago where one of these doctors was fertilizing all these women with his own semen vs unknown donor.

On the flipside of that, imagine carrying this baby all the way to term, having it, developing a bond with that child, and then the "real" parents sue to take that baby away when everyone finds out that it was someone else's egg/sperm.
The situation is fricked up all around and the fertility clinic is 100% responsible.

How awful. That baby was viable and given today’s technology could’ve survived outside the womb in the NICU. How is this even legal? I hope she never conceives again.

That's a risk you take. Why can't the real parents sue them now for killing their child?

You want to bring a child into this world so badly but only if it’s your DNA. Can’t be bothered with someone else’s child so I will just kill it. At least give birth and then sort it out.

Let’s flip this egg once again (pun intended). What if the biological parents find out this couple murdered their baby? Could they sue as well?
