It's worrying that you have such a loose grasp on the elementary concept of due process. I highly doubt you took a law school class of any sort if you think the wording of this order is, on its face, constitutional. They could have been easily added by Trump

And the likelihood of one being granted varies from circuit to circuit. The eastern district of ny is not the final say on us constitutional issues, and thank God for that. You act like they are and their rulings are never overturned lol.

Yeah except that no magistrate ordered their detention. Do you know what a warrant is? Not to even mention that they were denied access to their attorneys. People who had a perfectly legal justification for entering the country were denied entry. It's an unconstitutional detainment.

As it currently stands, it's unconstitutional and the executive is in open defiance of the judicial branch. They could have lodged an emergency appeal, but they didn't. You cannot openly defy a federal judge. Do you realize that the judiciary could have sent US Marshalls to ensure the order was upheald? That would have physically pitted two federal agencies against each other. This is the textbook definition of a Constitutional crisis.
