"You cannot charge a president with obstruction of justice for exercising his constitutional power to fire Comey and his constitutional authority to tell the Justice Department who to investigate, who not to investigate. That's what Thomas Jefferson did, that's what Lincoln did, that's what Roosevelt did. We have precedents that clearly establish that," Dershowitz told Fox News' "Fox and Friends" Monday morning.

True from a Constitutional aspect. The optics of it are pretty bad, though.

That was the exact argument from the left when the prospect of Hilary being elected was very real (didn’t happen)

We all know this and Im sure Mueller knows this and thanks to the memo we know the Russian collusion investigation is utter rubbish . So , what is Meuller doing then ? Even after the memo , Paul Ryan / Gowdy said the memo won't affect what Mueller is doing . WTF is he really doing ? Team Trump - probably .

Depends.
GOP President Nixon was not.
DNC President Clinton was.

No president can be charged in a court about governance. Technically a President can order any executive branch individual or department to do anything. For example Obama ordered DACA.

So Mueller cannot go to federal court and charge Trump with obstruction. He can however go to the House and claim obstruction. The House can then vote articles of impeachment to the Senate. The Senate holds a political trial (impeachment) where House members present evidence like a prosecutor, the Chief Justice acts as the judge, and individual senators act like the judge, jury, executioner, prosecutor, and defense.

You should have learned this in high school.
If the statute of limitations hasn’t run out, you may consider suing your Civics/Government teacher for malpractice!

It’s a shame such a beautiful reply is wasted on one who will never comprehend it.

Yeah, the Harvard law professor doesn't know what he's talking about. We should listen to Cruiserhog because he has a long history of intelligent and stable post.

Nixon and Clinton were both charged with obstruction

Dershowitz paints a pretty specific scenario

You're not smart enough to think for yourself

no he knows what he doing, hes on Fox. he is not going to argue the point because he has a producer in his ear.

when he is on Cnn they argue the corrupt intent written into the obstruction of justice statute because its an important concept in light of Trump's potential actions towards the SP

you people sure are naive on how things work.

Was lying to a grand jury part part of Bill Clinton’s constitutionally vested executive powers? Because firing a Comey and directing him was Trump’s, I could go on making you look stupid all day.

This is what your kind has been reduced to: spurious legal arguments about future potential offenses.
