Why can't white people just claim to be black?

I don't understand why we can't just call the left on this bluff? Challenge this thing and make the courts deal with admitting the illegality of affirmative action policies.
In my industry, on certain projects (usually public), we have to show a certain percentage of MBE (minority business enterprise) participation, in order to secure the project.
What would stop say a white guy from filing his business as an MBE business and claim to be black? Is there some sort of scientific process to proving someone to be a "minority"? I say call the bluff, see them twist up into knots with their failed logic, and find out what happens.

Certainly whites can identify as black.
The rule is that no one except the individual gets to identify themselves.
Look what happens when someone calls BS on a man identifying as a woman.

For years I've been checking NA anytime I'm asked. It's true, more or less. I've got family records of Cherokee lineage. 23&Me shows substantial Southwestern Indian lineage but it's Cherokee. They're not very accurate when it comes to NA. By culture and upbringing I'm Redneck-Irish, FWIW.
