I put this in another thread - if senate GOP can hold off of approving her nominee, then they can keep the VP tie break off of the table.

No. President nominates and must be confirmed by majority of both house and senate.

Biden will not be leaving for awhile. If he were to become deceased or resign down the road. She will pick AOC, Stacey, or Illan Omar. They will order her to chose Susan Rice.
