I do not have a dummy email address for football tickets and such. But are any of you polibarristers interested in an amicus in favor of Flynn.

I am an excellent brief writer, and researcher. I’m willing to round up a team probono. I’m perfectly willing to submit one regarding this farcical order by Judge Sullivan.

I can get on pacer and get the background.

I legit cannot believe how IDIOTIC it is to try to mess with prosecutorial discretion in this way.

Four years ago this would have surprised me.

I thought the dims and MSM Propaganda Machine and DOJ had reached their zenith and couldn't possibly be any more openly corrupt.

I hope Sidney stays the course and appeals the predetermined moronic decision that Judge Sullivan’s SJW law clerks who have never held a real job, or put themselves on the line for someone else, are writing right now with the assistance of those hacks at Lawfare.

This is seriously dangerous Doogan.

Would be so awesome if Kavabaw writes the decision upholding the dismissal

I’m only a state level pleb, so excuse my ignorance, but if the prosecutors want to drop the case how is this guy stopping that process? It’s up to them if they want to proceed or not, correct?

Would you mind explaining to the ignorant exactly what effect an amicus brief has on the proceedings? Can the judge actually allow a third party to influence whatever judgement is handed down?

What can actually be done by the judge, if the prosecution decides not to prosecute?

Not an expert, but I have watched a few episodes of Law and Order and I believe that is correct

Yes. I don’t even do criminal defense work, and I’m in federal court as a civil litigant only.

But the judge has no discretion to freaking deny an unopposed motion to dismiss. Prosecutors can dismiss whatever the frick they want to. They have unbridled discretion to do that.

He has not been sentenced. There is no final judgment. He has withdrawn his plea. It’s done.

Both parties in the case agree to the motion. Amicus briefs are thus irrelevant. The judge has, in this very own case, denied third-parties to file briefs or statements in support of Flynn's motions. The judge could theoretically enforce the plea, but he'd be most certainly reversed on appeal.

The judge would essentially deny an unopposed motion to dismiss, and sentence Flynn based on what I don’t know.

It’s a fascist overreach justified by Orange Man Bad and proof positive to me that Democrats want to run the entire country, and the entire criminal justice system based on their neurotic emotional weather vanes.

I want Something on record that some people think this is a fricking terrible idea.

I’m a state guy only, and in all my years I’ve never seen a judge interfere with a prosecutors motion to dismiss. He may say it’s a bad idea in chambers lol, but he would never overstep and deny it.
