Wait, wait...Swalwell is suing the FHA for reviewing their records of his mortgage

He says his mortgage was private and they had no right....

Swalwell is as scummy as scum comes. I'd love nothing more than for someone to legally slap the sh*t out of him. But IMO Pulte got way over his skis in the Schiff and Swalwell cases. James is very different.

Swalwell's DC place is NOT listed as HIS primary residence, but rather as his wife's. Their kids attend school in the area. It is their primary home. Swalwell lists his own primary residence as being in CA.

Not only do I think the DOJ will avoid filing charges in the Schiff or Swalwell cases, the DOJ is (independent of Swalwell's action) now conducting a parallel probe into potential misconduct by Pulte ( LINK).

This is an own-goal. Before this is over, Pulte's stupidity may actually make one of the most conniving deceitful pricks in WashDC look credible

But what if he was listed as a co-buyer in the mortgage transaction for the DC residence. Would the DC residence need to be entirely in his wife’s name to evade culpability? Same would be true for the residence in California if it has a FHA backed mortgage, it would have to be entirely in his name and not his wife’s.


In some areas like Louisiana you can get a homestead exemption for one property you declare as your primary residence, but if you co own it with a spouse or siblings they have to declare it too or you only get a partial homestead exemption.

Maybe if the rules allow a cobuyer to sign up for a second FHA mortgage at another residence that is not their primary residence, Congress should close the loophole.

Well, considering the loophole is almost certainly there for Congress, just as is the Q2yrs $500K home sale tax exclusion is, it likely isn't going anywhere.

I would think that reviewing swallowswell records is easy enough to brush off considering the fact that his position of messing with a known Chinese spy. A cursory look at his finances is warranted. As for DC home being in his wife’s name and not his is a bit odd, almost like they are hiding connections of something nefarious.

the question is access rather than review. Reviewing legally, accessed records is certainly not illegal. As to the question of legal access, I don't know what the specifics on legality are. I suspect in a general sense, Pulte has the ability to access. The question would be "is political motivation alone enough to justify access?"

Seems if the situation is set up this way and the wife is not drawing enough income to cover the home but swallows makes payments it’s akin to hiding assets

Ok. Im just trying to figure out how much validity this suit has for "reviewing", per the OP title. I can easily assume it's just something to keep his name positive in the news, especially after the video of the black lady going after him in his town hall.

But as another response said, he kind of earned having his records flagged for constant review.
