The Assistant Attorneys General signing on disposes of the absurd “no career prosecutors approved the dismissal” argument.

Also, Francisco is the SG, not IG.

This was all calculated on Sullivan’s part. He knew he didn’t have legal grounds to conduct this type of judicial inquiry. It’s all about framing the narrative. You can practically pull the headlines from the DoJ’s brief. “Flynn skates justice thanks in part to corrupt DoJ and Barr arguing their decision on whether or not to prosecute is not subject to judicial review”

So how long before the appeals court rules? I give the DOJ (Barr) credit for making this the biggest boom back he could. It is finally fair.

Exactly. It is a stall tactic. Sullivan wants Trump to pardon so badly for even more of that BS.

What is up with Roger Stone, he reports to prison I believe June 30th??

The entire leadership of the DOJ, not just the local US Attorney's office, and Flynn's defense counsel is in total agreement to cease all litigation against each other.

That is an overwhelming show of force. There's only one way the DC circuit can credibly rule on the Mandamus petition.

We never know... no one thought Sullivan would dare do what he has already. So the appeals court can and should end this. Let's hope.

After reading this and then Sullivans, it is almost Sullivan wrote his knowing full well the jig is up and he is getting pulled and instead wanted to get something else on the record on the way out.

So now the real question is it 2-1 or 3-0.

Judge Sullivan just got deservedly bitch-slapped by Solicitor General Francisco and the DOJ .... in a clear sign that they are prepared to take this issue all the way to SCOTUS ....

they are hoping for it to go to SCOTUS to further stall. How sick is that? If this current court punts this there is a serious problem.
