A typical lawyerly answer. Everything will be settled by the Supremes. You know with a little court packing in the future, everything will be determined by the courts and settled by the Supremes. Maybe they ought to rule in advance what are or are not legal orders. I can see this country is simply going to sh*it. I'm guessing whistleblowers and now conscientious objectors in the military will bring about the required cases to "test" this in the Gawd Almighty courts.

Not entirely. It is reasonably clever, even if entirely duplicitous.

If there WERE no illegal orders, and if Kelly, et al HAD advised military personnel to disobey his (definitionally legal) orders, they would arguably be violating section 2387 (at a minimum) by (to paraphrase that section) "inciting insubordination."

The problem with JD's "analysis" is that the Tweet did NOT advise military personnel to disregard LAWFUL orders, only unlawful ones. JD is changing the facts to support his narrative.

And if anyone thinks that this change was not intentional on JD's part, I have a lovely bridge to sell you ....

It's more flailing. They've dug in against lawful statements and lots of MAGA culture has made fools of themselves. They either just continue to dig in deeper until a new story takes over the news cycle or admit the foolishness of so many in the MAGA orbit. They've chosen the former.
