The Hill

This will be an interesting case to see how the whole "editorial vs. opinion" thing shakes out. Gotta think the Sandmann precedent could be a factor.

quote:

In the lawsuit filed Monday, Trump’s attorneys claim CNN “has sought to use its massive influence — purportedly as a ‘trusted’ news source — to defame the Plaintiff in the minds of its viewers and readers for the purpose of defeating him politically, culminating in CNN claiming credit for ‘[getting] Trump out’ in the 2020 presidential election.”

What an embarrassment for a major media network to be sued by a former President.

It’s a new low for CNN.

I don’t think it’s going to be very interesting. Trump will lose. When you’re a public figure, especially a politician, people can say whatever they want about you.

This isn't exactly true. Public figures have to show damage and prove malice.

Zero chance of success. He'll have to prove actual malice since he's a public figure by choice.

At least some lawyers will get paid. I hope they were smart enough to get paid up front.

I don't think he expects to win $475M, but if he drags it out enough it'll be cheaper for CNN to settle and that will be enough for Trump.

Maybe, but that is why I distinguished between editorial and opinion.

Don Lemon or Rachel Maddow tee off from their shows, so be it.

Doing it as part of a news broadcast or news article, though, should be a different thing. There were plenty of articles and headlines presented as “news” that were indisputably lies (not just “errors”).

I’m no legal expert, obviously, but I do believe the distinction matters.

Sandman didn’t set any precedent. He was paid by most accounts a nominal sum to go away.

The hard part for a public figure is proving the lies were done to induce damages.

It's very hard, but not impossible. But CNN doesn't want this to go to trial. They'll settle.

There’s a mortgage broker in San Diego who says you’re wrong.

Trump is a public figure. Sandmann was not at the time the defamatory words were published.

It’s more of a low for Trump

“They were mean to me!!!”

If this was Obama suing FOX y’all would be wetting yourselves.

This will get thrown out with the quickness.

It doesn't matter. CNN has insurance to pay for this. They won't fight beyond an initial response.
