Sounds like a Motion to Dismiss on that issue or a Motion in Limine to exclude the illegally obtained evidence upon which the case is based.

I would think knowingly using evidence that was illegally obtained and then covering up that fact to pursue a prosecution opens up a whole bunch of civil rights violations.

I think the call being illegally recorded is a problem for the recorder. Doesn’t make it inadmissible evidence, though.

Ummm yes it does. You can’t use illegally obtained evidence to prosecute anyone. Neither party consented to the recording and that is illegal in the state of Florida where she recorded the call.

I should clarify that I don’t know who made the recording and whether they’re a plaintiff in whatever case we are talking about. I think it would be inadmissible if so.

It should, otherwise it would be an easy way for corruption.

Get someone to procure evidence illegally and then give that person immunity from prosecution.
