FWI Look up the National Emergency Act of 1976.
The courts cant block it because Congress has a remedy to override a National Emergency declared by a president
They can Override it by passing a bill to end it with a simple majority( providing they have a president who will sign it)
Or they can override it with a Veto proof majority!
Given that they already passed an Act to "curtail a presidents Emergency proclamation" with a remedy the courts can't stop it.

The executive branch can ignore the judicial branch.
The Judicial branch doesn't have check and balance power over the executive branch because they don't have power of the purse or sword.
The Judicial Branch requires an Executive Branch to be willing to enforce its edicts or it requires Congress or the people to use their power to remove the executive, through either elections or impeachment!

The EO in my post stood for emergency order, not executive order. I'm well aware of what he's declaring. I'm also aware that he pussed out on the negotiation and willing to say so.
