Freedom of speech.
No laws against waving the Confederate flag.

Note to self,
He might be Trump appointee, but if he is a Yankee he's still going to hate the rebel flag.

hence the charge was obstruction of an official proceeding.
the story as presented by yahoo gave you the impression that the entire case was about the flag. its yahoo click bait.
yahoo left out the charges.
the idea was to infuriate you and get you to go off in their comments.

Is flying the flag of and celebrating another nation in the capital outrageous?

A GOP-appointed judge sentences a GOP protester to a sentence less-than-half the request of a Dem-appointed prosecutor but above the minimum and well-within sentencing guidelines for his crime.
To sane people, this would indicate that the judge is engaged in the fair application of the law.
Here, it is taken as an indication that the judge is “compromised” because some illuminati has pictures of the judge fricking a goat

At this point, the Washington Fed. justice program is providing cover for the unreasonable incarceration of hundreds of Americans for two years and more to come without a trial, or bail. Finding a dude guilty of parading and sentencing for three years will allow quick release as he has already served more than half his time.
Can you imagine the embarrassment if a dude that has been in pretrial detention for two years is found not guilty, or guilty of a misdemeanor. How do you compensate that person for loss of life. Ya don't. You just find him guilty of a crime large enough to cover the pre trial detention.
That judge will be declared salesman of the year for the confederate flag industry.

Unequal application of the law bothers some people. It doesn't bother others.

The same approach was used in the incarceration of the 180 folks thrown in jail for being present at the Waco biker massacre 10 years ago. Million dollar bonds assured the blue collar folks could not get out. The 2 minute gun fight resulted in 9 out of twelve deaths by law enforcement guns. When the local DA was elected out, the charges were dropped, claims of official misconduct were bundled up and put into a federal judge hands were they were pocket vetoed. FBI had an underlying presence in the massacre that the feds needed to keep out of trial publicity.
