The theft and disclosure of Trump's income tax data was the fault of an independent contractor, who is currently in prison.
One question is whether the IRS can even be held liable for the independent contractor's actions. I believe it can, but only if you show the IRS's actions were unreasonable under the circumstances.
Obviously the IRS security measures were insufficient, since the data got out, but insufficient is not the same as unreasonable. Reasonable security measures can fail, and its the fault of the criminal, not the security measures.
I have no idea whether the IRS acted reasonably.
There is also the question of the 2 year statute of limitations and whether that expired before Trump filed his suit. That is a legal question regarding when the two years started. I think the 2 tears started when Trump learned of the breach in 2022, meaning his case is time barred. Trump says the 2 years started in 2024 when he received notice from the IRS regarding its internal investigation. I dont know which argument wins.
Given all that, if the IRS were found liable, then obviously it would need to take corrective measures, including firing anyone responsible. Some of those measures have already been taken.
Trump is entitled to monetary damages. He claims the statutory damages are $10B, which is absurd. The statutory damages are $1,000 per disclosure. Data involving Trump, his two sons, and the Trump Organization were disclosed for multiple years. Even if you count each document as a separate offense, the statutory damages likely do not exceed $100,000.
Trump is free to prove his actual damages from the breach...damages to his reputation and brand, maybe emotional distress...but that would be a few million, not billion.

Thats a matter of opinion. But as I have stated in this thread, anyone who believes they have been a victim of weaponization is free to file their own lawsuit, and Im sure Trump will direct the DOJ to offer them a generous settlement. And Congress won't even try to stop him.

I honestly dont know what constitutes "weaponization", but I think many of the Jan. 6 participants can make a case for civil rights violations. And even if their case is weak the DOJ can settle with them.
I wouldnt want to see them get paid for case that is time barred or legally specious, though.

To suggest nothing happened and that the Biden DOJ did not weaponize the law against Americans is inaccurate. However, creating a new system that is untested is problematic.
Therefore, I am proposing that we create a weaponization fund that will be available to those who can prove their claim against the federal government through the Federal Tort Claims Act. We have a legal system already in place for people to make claims against the government. That does not need to be reinvented.
However, it is imperative that we allow people with meritorious weaponization claims to come forward and receive compensation through this fund. We have to recognize there was a wrong that must be made right if you can prove your claim through the existing process.
