when it comes to compelling evidence in court yes.

They generally give a lot of deference to the government but they can say “that’s bullshite”

and i’m not saying it, The SCOTUS is.

I am not asking you what the judge can use to review if privilege was properly invoked.

i’m asking you what it means for privilege to be properly invoked.

and the quote you keep posting, doesn’t say that.

Somehow you get the idea that the judicial branch is all powerful.The judge says this and that and that is the end of it.

The Constitution says otherwise and you don't seem to understand that.

Alien enemies act is not subject to judicial review.

Period.

(SCOTUS is an exception because they are constitutionally created as a co-equal; these lower courts are not constitutionally created but congressionally created and thus can't review this act)

Good Lord. The judge looks at the totality of the circumstances and makes a decision. How are you not understanding this? The standard is very clear. Which is likely why the Supreme Court used the words they did. No way you’re a lawyer.

If the President classifies it to be, then it is, correct? A judge doesn't determine what a State secret is or isn't.

in the context of State Secret Privilege, a judge /the Courts can call for disclosure of information that they do not believe is a genuine state secret.

I asked you what it means for privilege to be properly invoked and your responses is “judges look at the totality of the circumstances”

They look at them to determine what?

The answer of course is they look at evidence available to determine if the information the government seals to withhold actually falls under the privilege.

Meaning if it’s actually a state secret.

Nope. The Supreme Court used the words it did for a reason. Absolutely nowhere in The decision does it say what you claim. You’re wrong. Going on 3 days in a row over such a small issue. I’m impressed by your tenacity to prove over and over again you don’t understand the ruling.

Thats not completely true. It is subject to questions regarding constitutionality . You can't just misapply the act and then hid behind that wording.
