This is actually a fair, cogent and logical point. Those 3 are things that can be made rights through legislation, not through improper or intentionally manipulated interpretations of the constitution that are unfounded.
Many people are personally against abortion, but would be accepting of a legislated right to it. Going through the courts to make up rights without going through legislation is what has ruined this country's development in many ways and set relations back decades if not more.
Again, its not whether you believe that people should or should not have those rights, but just because bad precedent exists going against logic, does not mean that we should stick to them.
Otherwise, previous courts upheld slavery, segregation, voter rights, etc. that were rightly overturned.
