Why would it be incorrect

The direness of the situation is irrelevant. He needs congressional authority to impose tariffs. He either has it or he doesn't.

Congress can...pass something giving him the specific or broad authority

He's cited several, not the least of which is the IEEPA. Further, under the Trade Act of 1974, Congress ceded authority for the EB to identify foreign trade practices that are unfair, discriminatory or burden U.S. commerce, and then impose retaliatory tariffs on parties involved.

Congress could also revoke the Trump Tariffs altogether.

Remember when Obama care was just a tax even though everyone said it was not tax

Why doesn't the same thing apply for Tariffs - there is a wall that justifies their use and gives the president the power to do it if he specifically said the wrong law that doesn't mean that it is unlawful if there is a right law to be applied

I'm guessing that is the ruling
