This is a pretty big leap, legally. Every attorney I have seen discuss this, except Hank, disagrees with you. You and Hank go to the same law school? Did it offer Criminal Law I?

The Indiana Handgun Reference Manual states that posted "Guns Prohibited" signs at retail stores and businesses does not allow for trespass charges.

The establishment has to tell you to leave before trespass charges can be filed.

It does say you should respect their wishes but are not legally obligated to.

If you speed to a hospital with someone needing medical attention you’re breaking the law. Sometimes the circumstances dictate that breaking the law is the proper and correct thing to do…dumb arse!

I would love to see someone provide some analysis of the statute, rather than just making conclusory statements directly contradictory of the plain language of the statute.

Statute: You trespass if given notice in advantage not to enter, and signs constitute “notice.”

Experts: Yeah, but that is not what it MEANS.

Here is the Louisiana criminal trespass statute. It is quite different from the Indiana statute (nothing about signage), but it does require “express, legal, or implied authorization” to enter the property.

If you are specifically told NOT to enter, it would be difficult to argue that you in fact had such authorization.

Practically, you would probably have trouble finding an LEO willing to arrest the trespasser, rather than just making him leave.


EDIT
New Info. Louisiana has a Separate statute about advance notice and signage. Apparently, you CAN make someone a trespasser by posting a sign in Louisiana.

That's private property with no public access. That's not the same as enjoying public access while surreptitiously violating the wishes of the owner.

I understand that you believe this to be the case. You may be correct. Cite me to a statute or a case. Until then, I will rely upon the clear and unambiguous language of the statutes I have found.

Unless Louisiana law is REALLY different from every other jurisdiction, a business open to the public makes most people “invitees,” which would be the “legal consent” referenced in the statute.

But I cannot imagine that even Louisiana would preclude a business owner from revoking invitee status.
