Agree, but thats not how it works in many places. Go youtube squatters, and see how much pain they cause property owners and how difficult they are to remove.

I can see it now. A car thief can claim to be a squatter who rented your car and you have to file for a repossession order in a terminally slow court to get your car back.

Last I looked, a house is worth a lot more than most cars.

Also, as the article is presented this doesn’t sound like somebody that’s been there for 6 months. It sounds like they just popped in with a lease and said nope, I’m renting here.

LE shouldn’t be arbiters of these matters but the owner should get the benefit of the doubt. If it’s found they did have a lease and used LE to vacate the property….then the tenant should sue the hell out of the owner and owner charged with lying to the police. But the burden should be on the person waving around a document…not the legal owner of the property.

How is it civil? Does the squatter have a lease? Is there a domestic relationship? Did the squatter have permission to break and enter? Did the squatter occupy illegally and not violate criminal statutes?

Is there an underlying criminal violation? Sometimes. Should there be an arrrest? Arguably yes. But to regain POSSESSION of the premises you still need an FED action.

Looks like MI was able to change the law yrs ago to make it a criminal issue, so why other states arent following suit is the issue.
