The issue the OP is getting at, as I immediately understood it to be, is that a Harris County, TX court said the Sharia Law divorce was valid to begin with.

It would have been had he just given notice to the wife. That's why the whole Sharia point is largely missing the mark.

The fundamental issue with the divorce wasn't that it was under Sharia law of Pakistan. The fundamental issue is the notice that he gave her wasn't proper for Texas

The man used the law of sharia to initiate the divorce. Ultimately that is what caused the case to begin with, so in essence this does have to do with sharia law.

However, the ruling was based on being notified breaks Texas law. So to say this case has nothing to do with sharia law is incorrect. To say this ruling had nothing to do with sharia law is correct.

My man, I know. The issue was a Harris County court disagreed and said it was ok.

"A Harris County court recognized the Pakistani proceedings under the legal doctrine of international comity and dismissed her divorce petition. The court also denied her claim for division of the marital estate."

You need go no further than that statement. Without a doubt from the Criminal Courts to the Family Courts Harris County has the most screwed up Justice System in America.

So I'm not surprised the Texas Supreme Court had to undo the absurd ruling by this lower Harris County court.

What a mess.

Yes.

The Islamic law divorce can apparently be done with no notice to the wife.

Lower court was cool with that, so it approved a no notice divorce.

TXSC said that no notice divorce is not acceptable under U.S. law.

Internationally recognized divorces are typically validated domestically

This is a highly complicated matter and possibly an instance of first impression.

This is why we have appellate courts
