This is the AA fight I've been waiting for.
If they lose, then AA is officially not about minorities and is more about a general concept of "diversity", which, I believe, runs counter to the very wording of the laws (similar to the trans discrimination cases that the court just ruled on in recent years).
The problem is that if Asians are held to higher standards than even white people, then you're literally allowing schools to punish certain minority groups to help other minority groups, while white applicants remain protected more than the punished minority group.

Let me guess, you think that blacks shouldn't be arrested for criminal behavior, either. After all, as you leftists keep claiming, blacks can't be expected to abide by the same rules of civilized society that the rest of us do.

This is one of those magical arguments where "discriminate" doesn't mean discriminate.
The issue with AA was always this scenario: what happens to the system when a law written, effectively for African Americans specifically, but with generic language for palpability, gets upended by a non-African American race who surpasses white people?
Harvard is trying to argue that AA is about "diversity", even if that means punishing a minority group more than white people.

Because they say it isn’t, apparently.
They have an arbitrary model of how many students by race they want their incoming class to be regardless of how qualified those applicants are.
By definition, that should be considered the same quota system tossed by Bakke back in the 70s.

A lot of the argument with regards to schools isn’t the actual education you receive from them but the contacts you make by attending there.
Ivy League schools have inroads everywhere. Cal Tech has inroads at most tech companies including the ones in Silicon Valley close to the school.
Dropping a tier or two may not affect the quality of your education but potentially has a major impact on your hiring after graduation and your long term prospects if your networking suffers from being at a lower tier program.
TLDR - the education at Harvard isn’t necessarily better than other schools but it means you are in the “old boy network” which gets you opportunities.

If you have a perfect SAT and a 5.0 grade average and get bumped for someone who couldn’t spell “cat” if you spotted them the C and A, you have a right to be upset.
College admissions are supposed to be a meritocracy, as the people who get into top schools are supposed to be the top students.
