There is a difference between blacks and this type of kid. My business partner at work was black. Well educated, well spoken and a great guy.

Capital Murder, Murder and Manslaughter is all Texas has to offer when it comes to homicide.
He will probably be convicted of one of the first two.

Here's the information concerning Texas murder statutes

I dont know if they can get premeditation, but he definitely went there willing to use the knife before anything happened.

I would normally agree with the former. The Texas definition is slightly broader than most others. It may not meet that bar, but it’ll be a tight race between 1st and 2nd degree according to their statute of such.
