He's already snookered them to change the law that would've allowed the VP to send the Electoral College votes back to the state legislatures. If Pence couldn't have done it on Jan. 6, 2021, then why did they need a law explicitly forcing the VP simply to count the votes as presented?

If SCOTUS rules against Presidential Immunity, then Clinton, Bush, Hussein & Biden are on the menu for any misdeeds committed during their time in office.

Laws are clarified all the time without changing the legal effect.

This is only if they eliminate it entirely, which nobody is seeking to do.

Trump is trying to argue and expanded immunity much larger than the immunity that currently exists in law. He's arguing that he should be immune for not executive behavior and behavior after he was president. Currently the immunity only applies to official acts while in office.

States administer federal elections, not the federal government.

The problem is that some of you mistakenly believe what Trump was doing was investigating - he knew there was no fraud and nothing to investigate, he was instead attempting a coup.

Where was it proven he tried to "overthrow" the govt in the first place. Dont assume thats a proven point and then decide whether to prosecute. The whole matter is a joke and everyone knows it.

Yet the debate is whether, by rule and thus by law, the 2020 election could have been turned over to the House of Representatives for a potential investigation of the various state CONSTITUTIONAL BREACHES which accounted for the result.

Trump contended it was possible. He was right.

That was his effort. His effort was to throw the election to the House using existing EC rules. There was no attempted unarmed "insurrection" or "overthrow of the government." His effort was to have TX v PA heard in the House since SCOTUS shirked its responsibility in the case.

Though opponents claim there was no legal ability to do so, S.4573 (The Electoral Count Reform and Presidential Transition Improvement Act of 2022) says otherwise. It closed the EC procedural loophole which supposedly did not exist. So, if the same situation arises in the future, the sitting POTUS will not have the opportunity Trump did to force determination of the election to the House.
