How the Process Works
The Normal Rule: Under current Senate rules (Rule XXII), ending debate on legislation (invoking cloture) requires a three-fifths supermajority, which is 60 votes if there are no vacancies.
The Nuclear Option: A senator can raise a point of order that a simple majority (51 votes, or 50 plus the vice president’s tie-breaker) is sufficient to end debate. When the presiding officer rules against this, the ruling can be appealed and overturned by a simple majority vote, effectively rewriting the precedent of the chamber.
Past Precedents: According to the Brennan Center for Justice, the nuclear option was previously used in 2013 for executive branch and lower-court judicial nominees, and extended in 2017 for Supreme Court nominees, lowering the threshold for those votes to a simple majority.
