They can "fathom" it because they know that is how it is supposed to work. They are just not so pollyannish as to believe that after over 30 years of completely shirking its responsibilities that Congress is finally going to address issues in a manner that benefits the citizens of this country.

Justice Kavanaugh provided the solution when he invited Congress to “amend” the 14th "or otherwise enact new legislation” that strips automatic citizenship from the children of “those unlawfully or temporarily in the country.”
This legislation and the save America act has to be passed.
We cannot afford to accept feeble attempts from the RINOs any more.

Pass a bill making it a felony for an illegal to have a baby in this country. Or for any non citizen to come here with the express purpose to do it. Or to assist said process.
Also make it a felony to overstay your visa or enter the country illegally. Or assist anyone who has.

Can’t see the full text of Thomas’s dissent there. I’m sure that somewhere in it he stated that he is “standing on business.” If he didn’t include that, Ketanji won’t be able to understand.
