You cannot take away someone's property or enumerated constitutional rights absent due process of law. The watch list is:
A. Secret (people on the list rarely know they've been placed on it)
B. Not up for appeal (even if you know you're on the watch list, there's no mechanism to appeal that decision to get off of it)
C. There is no pre-termination hearing before one is placed on the watch list.
It would be a major constitutional violation to forfeit the Constitutional rights of individuals who are placed on the FBI Watch List or the No-Fly List.

That was the original issue... There are tons of law abiding americans on the no fly list that can't get off. So those individuals would lose their 2nd amendment rights without any recourse.
