Then pass a law stating that these groups are protected. That is Congress’s job, NOT the Court. So many of these progressive social issues could be solved by passing legislation but for some reason the left continues to insist on effectuating social progress via the judiciary.

Answer: They don’t have and cannot get the broad popular support needed for Congress to pass such laws.

Dems arent interested in doing things the legitimate and intended way. When in doubt, STACK THE COURTS AND RAM IT DOWN OUR THROATS!

well that's an easy decision. The dems have made it clear that sex and gender are different things. The law does not address gender.

Agree that orientation and gender identity are separate categories from sex - the whole concept of LGBT depends on that.

But it's not a slam dunk in all situations. For example, if someone is fired after transitioning, they have a sex discrimination argument. It's the same person, and they were good enough as a man but not good enough as a woman.

In such a case it would be obvious their mental capacity had degraded exponentially from the time they were hired.
