This is the antiSLAPP statute, I think.

DC Code

I guess that is substantive enough to be Erie adopted.

You interpreted that very different than a reasonable person would have.

Defending your client does allow you to make allegations on a good faith information and belief. If the allegations turn out to be unproved after the trial on the merits then you are still immune from suit (or rather the suit is subject to a privilege defense) which shields lawyers from liability for things stated in Court pleadings unless there was actual knowledge of falsity.

Things like - what Dominion's instruction manual says, Texas rejecting them bc they were so insecure, Michigan and Georgia machine malfunctions, Dominion's CEO lying to the face of a Michigan Legislator as he denied that the machines could be hooked up to the internet support a good faith allegation that the machines were at least part of this fraud scheme.

Further, Truth is a defense to a defamation claim. Which means - break open the Dominion mahcines in every state in the footprint.

He is absolutely right about that. Dominion seems unconcerned.

"Seems" being the key word, lol. Filing the suit, even if it never goes to trial, shows future customers that they tried to defend themselves, a little, lol.

There is a punis claim, right? But it's a 1:1 ration in this suit IIRC. That would easily clear constitutionality.

Absolutely correct. That said, I think Dominion is focused on his extra-judicial statements. I wouldn't think those are privileged.

It’s what Rudy said. He said the amount asked for is an act of intimidation to wipe out and censor free speech and the ability of lawyers to vigorously represent their clients and that he is going to explore a counter suit for those constitutional violations.

when a defendant in a defamation suit threatens to investigate whether his slanders are actually true, he is acknowledging that he has a big problem.

This suit is based on what Rudy said in the public not in court. I don’t think any of the pleadings he signed alleged fraud or had the claims against Dominion.

How was dominion injured? If anything, they have business of everyone trying to stay in office "by any means necessary"

Dominion will have to prove Rudy's statements are false.

Rudy does not have to prove they are true.

Agree. They are timing these lawsuits in a way to define the exact lawyer client relationships.

I assume one of Rudy’s affirmative defenses will be asserting truth. To succeed on that affirmative defense, he will have to prove they are true.
