FORT LAUDERDALE, Fla. - The families of two victims of the Marjory Stoneman Douglas shooting on Wednesday sued the maker and seller of the weapon used in the rampage, claiming they should be held partially responsible for what Nikolas Cruz did with it.

quote:

The parents of Jaime Guttenberg and Alex Schachter want a judge to clear the way for them to claim damages against American Outdoor Brands, formerly known as Smith & Wesson, and Sunrise Tactical Supply. The Coral Springs store is where Cruz purchased the AR-15-style weapon used in the Feb. 14 shooting spree.

Day 1: Motion to Dismiss
Day 2: Granted
Day 3: Appeal Denied
Day 4: Certiorari Denied

It will not go quite that quickly, but in "judicial time" it will seem like it did.

People grieve differently.

Can't imagine my child murdered with a gun sitting in class

Would the process be any different if they were killed after being plowed into by a drunk driver?

They would be better off suing Cruz parents

I mean they would prolly be suing that person or company instead (if a company vehicle)

Oh I see, you weren’t looking for an answer in reality

Guess he'd try to sue Seirra Nevada for selling the beer. Would go nowhere.

Which company would you like to be involved in this hypothetical situation?

Remind me, but didn’t the Sandy Hook parents try this, lose, and get stuck with massive lawyer fees for the gun manufacturers?

One group trying this is understandable. Trying this repeatedly when the end result is a huge legal bill is insanity.

It’s not like this is getting to a jury where they can play on heartstrings to win the case.

It would be more appropriate if they sued Odumbf*ck and the complete f*cking morons in his administration for instituting the insane PROMISE program.

It would be comparable to suing the car manufacturer.

no. Colorado

We Lost Our Daughter to a Mass Shooter and Now Owe $203,000 to His Ammo Dealer

quote:

Attorneys at Arnold and Porter and the Brady Center to Prevent Gun Violence brought the lawsuit for us, pro bono. We knew the risks of bringing the case. We knew that Colorado and Congress have given special protection of the gun industry, and we knew that under Colorado law we could even be ordered to pay attorneys’ fees because of those special protections.

quote:

To make matters worse, the judge ordered that we pay $203,000. This is an outrageous amount, especially given that this case was decided after one single motion! Lucky Gunner has said that it is going to donate all these fees to “gun rights” groups. The thought is disgusting to us that Lucky Gunner does not even plan to use this money to pay for their attorney’s fees.

i think, but not sure, that Sandy Hook was such a shite show that they didn't go after attorney's fees there

What lawyers are advising these people to do this? Oh yeah, the unethical ones (haha) who want their name in the Associated Press a few times. There is so much case law and precedent going against them here. You can't sue firearm makers. I don't care about grief. Right is right and wrong is wrong. It's not right for them to try and ruin the life of the gun shop owner because some kid went on a rampage.

Proper compensation would be having the shooter as their slave for the rest of his life. Decades of hard labor, wearing rags and chains, and eating grits and chicken feet, might dissuade future shooters.

Waste of time and money to sue those not responsible.

Vendor should counter sue.
Maker too.
