BY JONATHAN TURLEY, OPINION CONTRIBUTOR - 02/17/24 10:30 AM ET

In laying the foundation for his sweeping decision against former President Donald Trump, Judge Arthur Engoron observed that “this is a venial sin, not a mortal sin.” Yet, at $355 million, one would think that Engoron had found Trump to be the source of Original Sin.

The judgment against Trump (and his family and associates) was met with a level of unrestrained celebration by many in New York that bordered on the indecent. Attorney General Letitia James declared not only that Trump would be barred from doing business in New York for three years, but that the damages would come to roughly $460 million once interest was included.

That makes the damages against Trump greater than the gross national product of some countries, including Micronesia. Yet the court admitted that not a single dollar was lost by the banks from these dealings. Indeed, witnesses testified that they wanted to do more business with Trump, who was described as a “whale” client with high yield business opportunities.

Undervaluing and overvaluing property is a longstanding practice in New York real estate. The forms submitted by the Trump organization cautioned the banks to do their own estimates and the loans were paid in full and on time. Yet, the New York law used by James is a curiosity because it does not actually require a victim. Indeed, everyone can make ample profits and still allow for an investigation into “repeated fraudulent or illegal acts.”

Having campaigned on bagging Trump on any basis, James turned the law into a virtual license to hunt him down along with his family and his associates.

Engoron proved the perfect judge for the case. The opinion itself seems almost cathartic for the jurist who struggled with Trump inside and outside of court. In the judgment, Engoron fulfilled Oscar Wilde’s rule that the only way to be rid of temptation is to yield to it. He ordered everything short of throwing Trump into a wood chipper.

The size of the damages is grotesque and should shock the conscience of any judge on appeal. Even if the Democrat-appointed judges on the New York Court of Appeals were to ignore the obvious inequity and unfairness, the United States Supreme Court could intervene.

Barred from doing business in NY for 3 years bankrupts him. Can he move Trump Towers, nope.

Any lawyers care to comment? Can he give the CEO position to Eric again as he did during the Presidency?

These sick marxists made Eric shut down a St Jude's charity.

Many companies are now talking about leaving the state of New York because of this ruling. You can do everything correct and still be found guilty, the judge and the state does not realize this ruling is going to affect New York and New York city in a huge way.

Anything they can do to take him down; and it still won’t work. Must suck to be them.

It’s a terrible injustice. I hope his appeal is successful.

The ruling didn’t dissolve the Trump enterprise certs, so the company can still do business in NY. What was ruled is that Donald, Don Jr. nor Eric can head the company for 2-3 years. The company will also have independent monitoring during that timeframe.

They would burn the entire nation to the ground as long as they get to rule over the ashes.

NY was already having issues, especially after 2020, but this is going to hasten their demise. The 2 NY cases are more an indication of the extremities their business regulatory environment exists in today than improper judgments. Both cases are based in somewhat irrational business laws.

Yet another illustration of how profoundly broken our justice system is.

That's putting it very mildly.

A lot of New York’s success went back to the Dutch and later English commercial culture.

These people are destroying the city.

Trump is going to test the limits to which his conservative majority can bail him out. The left will go ballistically insane if they end up ruling for him in case after case. Roberts won't want to go there.

Trump can sell all of his properties and I’m not sure why he hasn’t done that by now. If I were him I’d sell everything and move to Monaco, Luxembourg, Dubai, etc. the issue is I’m betting none of those type places will welcome or want him. Maybe Israel is an option he seems to really love Israel.

Every Corporation in NY, not only New York City, recognizes that New York State is now officially a non friendly business environment.

Suddenly the escape of Rush Limbaugh and Susan Hannity looks well advised.

Carouse Hinds escaped decades ago, moving to Texas.

Trump won’t go bankrupt. That’s wishful thinking.

But moving out of that hell hole causes more damage to New York as a whole.

This affects at least two of his kids also. Don't they have to give up the decision making for two to three years? And isn't someone appointed to make decisions for this time?

It's unlikely the USSC would intervene in these state cases. State's rights and all that.
