So let's get this straight, it wasn't ruled unconstitutional. Therefore, it doesn't matter whether Kavanaugh threw them a bone, it still isn't unconstitutional.

Nowhere in Kavanaugh's concurrence did he say it was unconstitutional. The CDC exceeding their statutory authority doesn't make it unconstitutional.

And it hasn't been ruled on again so it still isn't unconstitutional.

YOU are the one who said that the Supreme Court held it was constitutional.

They did not.

They were simply ruling on a stay.

By saying that they "exceeded their authority" Kavanaugh is saying that what they did IN THIS INSTANCE was unconstitutional.

They haven't yet ruled on what the CDC can do.

Almost every government agency is allowed to issue ruling and regulations to carry out the purpose and meaning of the laws that Congress passes. Some are specifically delegated in the law itself -- for which the agency rules are given more latitude.

But, Congress is not allowed to give agencies certain powers -- i.e., the improper delegation of authority. A great example of that is the recent CDC whereby they wrote "rules" that would imprison and fine landlords who evict nonpaying tenants. I don't think you need to be Clarence Darrow to understand that any Congressional act that would allow a government agency to impose it's own jail time on individual would be an EXTREME improper delegation of authority and would be completely unconstitutional.

There is no current Congressional law allowing for the CDC to issue a moratorium. Therefore it is impossible to tell if its an improper delegation of authority. If Congress had granted the CDC to impose any penalties it wishes (including imposing jail time) on landlords, that would almost certainly be shot down. Can Congress allow the CDC to extend moratoriums? We don't know because (a) Congress hasn't done that, and (b) that case hasn't been decided yet. Certainly there will be a Fifth Amendment challenge on an illegal taking.

But, what by "exceeding their authority" they did issue an UNCONSTITUTIONAL moratorium in this case. We just don't know whether any particular moratorium that the Congress may wish to delegate to the CDC will be unconstitutional in the future -- the case hasn't presented itself yet.

So, your claim that the Supreme Court held that the CDC's moratorium was constitutional was dead f*cking WRONG. The Supreme Court did no such thing. All they did was leave a stay in place. Seriously, just f*cking OWN IT and move the f*ck along.
