it's the mythology of stare decisis. i almost got into this a few days ago with hank but i had to work

the mythology of stare decisis only really works if we ignore how it's often ignored when giving more powers to the state, and then reconsideration of possible mistakes is eliminated by....stare decisis. Justice Roberts is going to become a real villain using this very argument, you just wait

our criminal jurisprudence has been one constitutional violation over another for about 50 years now. it's almost impossible to walk back this authoritarianism, which has a double impact of (1) allowing the leviathan to rape us daily and (2) infecting new areas of dispute with the tainted authoritarianism.

Hell, here in Arkansas the statewide paper posts where DWI checkpoints and speed traps will be located for the day. And people say we are backwards in this state. For the most part we are but not in this case.

It seemed like police overstep and militarization was starting to get a lot of attention, then poof, BLM stepped in and drove a wedge along racial lines and derailed the conversation.

The stupid part of the case law is even if one says driving is purely a privilege, I don't recall the clause in the 4th Amendment saying, "This only applies when doing something you have a fundamental right to".

How ANY police department has a team like that is insane. Looks like something from an old scifi movie or East Germany, now it is the norm

Exactly. Like many things in govt, stare decisis only really works in one direction.

Hell. The entire stated reason for inventing the TSA was to protect air travel yet, pretty much all of TSA arrests are for shite unrelated to air travel safety. Same for homeland security.

Both just became a sideways way to conduct searches for crimes unrelated to their reason for being. Searches that you otherwise would never allow.

Again, under the guise of "travel is a privilege".

I've been telling people this for years.

You don't have a real constitution if the ONLY people who arbitrate what the fricking thing says is a branch of the entity trying to violate it!

The whole premise that plain language is somehow indecipherable absent being a constitutional scholar defeats the entire fricking purpose of the thing.

the only reason why DAs and Sheriffs in LA want to keep weed illegal is b/c it's an easy way to search cars and intimidate people

these laws are not about safety. these laws are about justifying the use of force over the population

like i said earlier, this is way above the pay grade of the drone-officers who implement these policies

the best part is that this isn't even a left or right issue, ultimately. those who claim to be "Conservative" and fear "globalists taking over" or "socialism being used as authoritarianism" cannot also ideologically support the enforcement wing of these policies. Leftists who acknowledge over policing cannot ideologically support the expansion of the very state power that allows this policing

Did you know that the vast majority of citations and arrests at DWI checkpoints are NOT related to impaired driving?

The goal of any sensible government should be that their police forces have as little reason as possible to interact with citizens because, NEGATIVE interactions are a pure mathematical function of total interactions.

As such, all interactions should be frickING NECESSARY!!!!

TSA
Checkpoints
Homeland Security

Even if we pretend they start with good intentions, they ALWAYS, 100% of the time, devolve into a method for doing shite that otherwise would not be allowed by the citizens.
