Down the middle, centrist Hank said Lin Wood only got Sandmann 5k in the settlement with CNN.

In case you are unaware, Hank is an attorney. As such he handles quarter of billion dollar defamation suits all the time and says 5k is the standard amount of settlements.

Wait. I am no math wizard, but if 5,000 is the average, you are telling me he has handled over 50,000 defamation suits?

You said he has handled over $250M worth of defamation suits. Either he has lost a lot and gotten a lot of zeros or the average really is close to 5,000 in which case that is an absurd amount of cases.

Also, how many defamation suits are as high-profile as this one?

Prefacing this by saying I have already called Kyle an American Hero, and a good Patriot.

I have killed in the military, any time I think about it I get sick. It gets better over time, but it's always there right below the surface

You just tell yourself you did the right thing, and that they were trying to kill you or your friends. It helps.

But anyone who says it doesn't affect them, is not someone I would EVER want around me or my family. That is a fricked up individual.

First, let's just use "defamation," since some of it is written and some of it is oral.

It entirely depends upon phrasing. Opinions are largely protected, while false factual assertions are not. (e.g. "Kyle is a Supremacist" can get you in trouble, while "I think/believe that Kyle is a Supremacist" probably will not. Doubly-so if there is evidence that can reasonably be interpreted that way, though I've not seen that here.)

Most TV talking heads are smart enough to phrase things in the form of opinions, rather than statements of fact.

No, I did not.

I have said that my experience with defamation cases says that the case probably settled for something in the five FIGURES, slightly in excess of "cost of defense." I think the $50,000 figure is likely a bit low, but I doubt the settlement reached six figures.

In July, I said the following of the two settlements combined:

In legal terms, it is called "nuisance value." He MIGHT have gotten a couple hundred thousand from the two settlements combined ... but I doubt it.
As to the CNN case alone, I said the following:

Every attorney on this board has told you that pleaded damage figures are always inflated ... sometimes to a ridiculous extent.

If you got a paper cut, your lawyer could PLEAD for $5 billion. It would be no more laughable than the $250 million pleading in this case.

His lawyer picked a number that would assure news coverage.
