It's both criminal and civil. Most federal agencies have civil penalties to resolve issues for example the IRS. It's difficult for agents to get the US Attorney to take cases where there is comparable civil remedies.
Homeland Security enforces the civil aspect because it's less costly and easier to Imagine the cost to the taxpayers for imprisonment. Imagine the cost to keep over 20k illegals in jail. You also have 4th Amendment rights with criminal cases.
The civil remedy enacted by Congress is removal from the United States. It is a civil procedure that can be done by summary judgment. The facts are easy to prove and not disputable. Illegals are not granted the same due process as a criminal case. Civil cases are administered in Immigration Courts not District Courts.

Build some tent prisons like they use during Mardi Gras, and put the Bayou Classic revelers that inevitably get arrested in there. As for the illegals, surely some of the cages Obama used for them are still around.
