I’ve been curious that if they argued for relief for minorities how would the libs on the court deal with this . With the amount of pressure out there if this got pushed Roe v Wade may have a chance to be overturned .

If Roe is overturned, abortion will not be made illegal everywhere. Before Roe, abortion was legal in several states. If Roe is overturned, abortion would most likely be legal in at least 24 states where the majority of the US population lives.

I read the brief

Mississippi passed a law banning abortions after 15 wks of pregnancy, unless there was a medical emergency.

A hospital sued the state saying the law was unconstitutional pursuant to RvW, which prohibits abortion bans which affect abortions prior to viability of the baby.

Mississippi argued that RvW should not apply bc it should be overruled. They say there’s no basis in the constitution text for creating an abortion right, so there’s no basis for courts to use to understand how the laws relating to abortion should be interpreted. As a result the goalposts keep which prevents any consistent standards. Further, abortion doesn’t relate to privacy interests of family, etc like other Privacy decisions bc abortion involves harming another life or potential life. No other privacy law authorizes harm to another person.

Stare Decisis principles talk about when precedent should be overturned. Mississippi says stare decisis doesn’t prevent overruling RvW bc the decision it relies on old science (regarding viability) and its unworkable to try to apply the law. Further, it argues that removing the Abortion issue from the legislative process, the political discourse is poisoned.

It’s a good brief.

If leftists weren’t rabidly insane over their sacrament - then Mississippi should win. But . . . Wise Latina, Traitorous Roberts - may have other plans

And you may not realize it but you inadvertently probably just stated the rationale behind why many constitutional conservatives think Roe should be overruled

It wasn't inadvertent.

If people really want to stop abortions, a change of heart is needed in individuals. Laws that reflect a minority view (abortion is murder) will not change reality on the ground.

As I’ve gotten older I’ve become more opposed to abortion on policy grounds. I used to be ambivalent about it, thinking It’s not something I would ever do-so it was irrelevant to me if it were legal. As I’ve thought more about it, and matured, I do believe that it is a barbaric practice and states should be able to make laws that regulate it.

But Roe has never made sense from a constitutional standpoint; and it should be overturned on that basis alone. It’s a state issue. People in different states with different cultures have different views about it. Someone who lives in San Francisco doesn’t need to be making decisions about abortion for someone who lives in Alabama.

Why do they need nine months?

I assume that's to have time in order to determine how to find some bullshite reason that can be used to justify the Roe decision. Thomas has got to be chomping at the bit, but I have No faith in any others on the USSC.

That’s only to hear it. They’ll sometimes make a ruling on procedural matters after oral arguments.
