His entire argument balances delicately on the assumption that Trump committed a clear crime that no one, including him, has even been charged with.

This case was argued in the briefs filed by the parties in this case. Oral arguments are for the justices to get questions in the record. They will vote on this privately, probably today. Who knows when decision will be released other than before Colorado election.

This dumbass is refusing to pivot to secondary or tertiary arguments. He is forging ahead despite the fact that they are clearly not buying it. Colorado is going to lose unless something changes here, but he doesn't appear to be willing to try anything else.

Despite being a complete Prog, Kagan is someone people at least respect.
She somewhat deserves to be there and can be reasonable, even if I disagree with her a lot.

I have heard enough that Colorado will lose this. Justices are not buying this and just said the is a vehicle to find Trump guilty of insurrection and he has NOT been charged. Seems case is over right there. He isn't guilty therefore can't be barred.

You can't always tell in oral argument. I had to argue once before the LASpCrt and they peppered me and obliterated me with questions, barely asked my opponent a single one. I won unanimously (on very technical grounds).
