Yeah that may be a little extreme, but I can assure you it's a very common practice for the bailiffs guarding the door to listen intently as to the progress of deliberations. Mostly because they're ready to be done with a jury trial and take it to the house. It easily slips out from there. Not necessarily to anyone and everyone, but to a few. And from there, it just takes one soul who is armed and ready to let their exclusive scoop slip.

It makes sense to file both. Attorneys do this all the time. They'll file a Motion asking for relief but also request alternative relief based on the same facts and legal arguments. This is a CYA motion in case the jury returns a guilty verdict and he can't get his motion for a mistrial with prejudice granted. It wouldn't be an acquittal but a retrial is better than having to go through the appeals process

Yeah, I'd guess at least few people in the courthouse have a good idea where they are.

A hung jury SHOULD have been even more motivation for the defense to go at the judge for a dismissal. But then doing that would effectively upstage their position , make Barnes right, and they couldn't have that now. Noooooo!

Lets map the outcomes and their chances:
Day 1 of deliberation:
Acquittal - High
Conviction - Low
Compromise verdict -Low
Hung - Low
Dismissal with prejudice - Low
Defense feels great, right?
Day 2:
Acquittal -Low
Conviction - Low
Hung - High
Compromise verdict - High
Dismissal with prejudice - Low
Now, the defenses chances just took a shite. Adding a dismissal option that wont get the judge burned at the stake starts to look like a nice option.
Day 3:
Acquittal -Low
Conviction - Low
Hung - High
Compromise verdict - High
Dismissal with prejudice - Low
Dismissal with retrial - Too soon to tell.
This is the ONLY way the second motion to dismiss makes sense.
