Ok, he is right he's not within "arms reach of the defendant" he's less than a foot from grabbing the gun though.

Here’s the problem with provocation. Say KR DID provoke Rosebaum. The second KR turns and flees, the provocation is over and everything basically resets.

For instance, I point a gun at someone: They come at me: i run away. That “provocation” doesn’t last for infinity. He can’t chase me from Mobile to New Orleans. He’s no longer in self-defense; he’s clearly offensive which allows me to defend myself.

Either way, KR acted in self-defense. And that’s if you believe Littlebinger’s unbelievable accusation that KR provoked Rosenbaum.

Rosenbaum was 5’2”

Within arms reach is pretty close considering his lack of wingspan.

There’s no way that jury, as a group in deliberation, doesn’t all say at the same time, “Sorry, but I can’t see shite in that video. I can’t even tell which one is Kyle, where the gun even is, much less if he’s pointing it at someone or in some direction. Even blown up and enhanced, you can’t make out a damn thing.”

ADA is literally just making shite up and hoping power of suggestion creates visions of what he’s describing in juror’s minds.

The more he says that Rosenbaum wasn’t close to the Defendant (while literally showing the jury that Rosenbaum was around two feet away and running at him full sprint) the more he loses credibility with the jury.

Furthermore if the provocation is that he pointed a gun at the Ziminski’s the evidence points towards him first turning and attempting to go back in the direction he came. It is at this point he encounters Rosenbaum and again changes directions and runs towards the car lot. So you have an alleged provocation, you have disengagement followed by a second engagement and an attempt to disengage a second time.

This guy is telling everybody what they should see in the video compared to letting them interpret the video themselves. We saw this same strategy from Schiff when he read his interpretation of the Ukraine call. fricking rubes.
