Justice Ruth Bader Ginsburg was absent from the Supreme Court bench for the second day in a row on Tuesday.
Chief Justice John Roberts noted Ginsburg’s absence when the justices took their seats for the second time in the new year.
Repeating what he said Monday, Roberts said Ginsburg is “unable to be present” for the court’s sitting, but will participate in the decisions using transcripts of the arguments and court briefs.
Ginsburg, who was forced to miss her first oral argument in more than 25 years on Monday, is still recuperating at home after surgery to remove two cancerous nodules from the lower lobe of her left lung on Dec. 21.

So a "sitting" judge need not be present to preside over a case. Hmmm. Interdasting.

I mean do they have the same sick leave policies of all Federal employees, which means paid sick leave, that accumulates over time if not used, it is always there, unless it is used.

and...

still recuperating at home after surgery
They will just send this same note every day

How do we know it is her decision being made if she isn't present. What if she is really dead?

It's probable, don't you think?

If a judge doesn't need to be present, then why judges?

The idea that she is minimally fulfilling her constitutional duties, let alone managing an office of clerks, grilling our nation’s most skilled appellate advocates, or poring over legal precedent and weaving together incisive constitutional arguments, is no longer tenable. What a shameful charade it is.

BULL shite!
She’s either there or she doesn’t vote. End of discussion.

I think it is rare that they would call off sick or PTO on oral arguments; they would call for oral arguments on a day that no Justice called off work.
They have a crap ton of down time, no? So calling off oral arguments is rare.
They scheduled the oral arguments before they knew she was sick/sick?

It is like a surgeon and a nurse, the nurse does the shite work but the doc shows for the surgery.
Or a lawyer and a legal assistant, the legal assistant does all the shite work and the lawyer shows up for court.

My guess is that everything was scheduled months in advance based on when the court would be in session.
What I’m curious about is how often a justice skips oral arguments without being recused from the case.

Exactly. Or how long they can call her off until they spray some more Febreeze.

I’m just waiting for whenever the moment is that she takes a turn for the worst and they put her in an induced coma just to “keep her alive”.
